DOVER, DELAWARE – July 23, 2026 – On July 23, 2026, Governor Matt Meyer signed Senate Bill 168 into law, enabling delivery and curbside takeout of beer, wine, and spirits from off-premises package store licensees via a third-party delivery license, making Delaware the 37th state to allow off-premises consumer delivery.
The new law expands delivery options for customers, following the passage of SB 166 in 2025, which enabled delivery of alcohol from on-premises restaurants. Consumers may now choose curbside pickup or third-party home delivery of beer, wine, and spirits. Delaware is one of the few states where alcohol sales are generally limited to licensed liquor stores, rather than grocery stores.
Off-premises delivery is permitted only within a 3-mile radius of the liquor store where the order was placed and orders may only be delivered to a person aged 21 years or older with a valid form of identification. Deliveries are prohibited to certain locations, including schools, hospitals, state-operated buildings, storage facilities, and undergraduate college housing.
The law aligns Delaware with a majority of states that allow third-party alcohol delivery and goes into effect on January 23, 2027, six months after the governor’s signature.
